Rules and Regulations

  1. The Contest is sponsored by Weston Bakeries Limited ("Weston"). No purchase is necessary. This Contest is open to all elementary schools in Canada (with the exception of Quebec schools) that have registered for the WonderCares™ Fitness Challenge program.  Official contest registration forms and contest rules are available on the Wonderbread website, www.wonderbread.ca and on www.wonderfitness.ca. Click on WonderCares™ Fitness Challenge contest and fill out the official registration form including details of your school and submit. Registrations received will be deemed to have been submitted by an Authorized Contact Person for the school in question. Authorized Contact Person means the person submitting the registration on the school's behalf has obtained the school's principal's permission to participate in this contest. Online entries must be received between 12:01 am April 18, 2011 EST and 11:59pm June 10, 2011 EST "Contest Period". LIMIT: One registration per school.
  2. Every week during the Contest Period, registered schools should submit their fitness total minutes for their school online at www.wonderfitness.ca, by email to fitnesstotals@wonderfitness.ca, by phone at 1-888-660-9997 x229 or by fax at 1-866-978-1653 (toll-free) or 416-466-5002. For each full week that fitness totals are submitted, one ballot will be entered on behalf of the school for a chance to win the Grand Prize and Weekly Prizes. From May 17, 2011 until the contest close at 11:59pm June 10, 2011, fitness total minutes entered in that period by registered schools will receive two ballots for each of those weeks.
  3. There will be one (1) Grand Prize available to be won, drawn from all ballots entered by registered schools by contest closing.
  4. The Grand Prize consists of $10,000 CDN to be used toward the purchase of playground equipment for the winning school. Prize must be accepted as awarded. No substitutions permitted.
  5. There will be forty (40) Weekly Prizes (5 per week) available to be won, drawn from all ballots entered by registered schools starting April 26, 2011.
  6. The Weekly Prizes consist of sporting equipment from a list, to be provided at the time, that may include, but is not limited to: basketballs, soccer balls, footballs, baseballs, baseball bats, volleyballs, tennis racquets, badminton racquets, dodge-balls, and floor hockey sticks. The suggested retail value of each Weekly Prize is $100 CDN. Prizes must be accepted as awarded. No substitutions permitted.
  7. There will be one (1) Mid-program prize available to be won, drawn from all ballots entered by registered schools between May 11, 2011 and May 16, 2011.
  8. The Mid-program prize consists of sporting equipment from a list, to be provided at the time, that may include, but is not limited to: basketballs, soccer balls, footballs, baseballs, baseball bats, volleyballs, tennis racquets, badminton racquets, dodge-balls, and floor hockey sticks. The suggested retail value of the Mid-program prize is $4,000 CDN. Prizes must be accepted as awarded. No substitutions permitted.
  9. On June 13, 2011 at eleven o'clock a.m. (11am), EST, a draw from all ballots entered for the registered schools during the Contest Period will be conducted by a computerized, random draw to select the potential Grand Prize winning school. For the Weekly Prizes, a random draw will occur each Monday starting on April 26, 2011 and cease on June 13, 2011 of the ballots entered to date; weekly ballots drawn will be reentered into the Grand Prize draw. Immediately after any draw, MIR Communications (Contest Judge) (hereinafter "MIR") will contact the potential winner(s) at the telephone number provided on the entry form which must still be valid. The potential winner will have 7 days after being contacted by telephone ("Contact Deadline") to contact MIR by telephone using the telephone number provided.  If the potential winning school(s), who otherwise complies with all the requirements of the rules, is to be declared winner, a school representative will be required to correctly answer a mathematical skill-testing question without the aid of any mechanical, electronic or similar device. Upon answering the question correctly, MIR will make arrangements for awarding the Grand Prize and the Weekly Prize(s).  Should the potential winning school(s) not reply to MIR by telephone by the end of the Contact Deadline, or potential winner does not otherwise comply with the contest requirements, that potential winning school will be deemed to have forfeited any rights to the Grand Prize and Weekly Prize(s), and MIR will have the right to select an alternate potential winner from among the remaining eligible entries and contact such persons in the manner provided above except that the alternative potential winning school(s) will be given a new Contact Deadline which 7 days after contact is made.  Before being declared a winner, a selected school(s) entry must be verified by the contest organizers. Winning school(s) agrees to accept the Grand Prize and/or Weekly Prize as awarded, and the Grand Prize and/or Weekly Prize is not transferable or convertible to cash or credit. Weston retains the right, in its absolute discretion, to make substitutions of equivalent kind or value in the event of the unavailability of any component of the Grand Prize and Weekly Prizes for any reason. The decisions of Weston on all issues relating to the contest will be final and binding on all entrants.
  10. Chances of winning depend on the total number of eligible school ballots entered into the draw. School registrations and fitness minutes that are submitted from unauthorized sources as determined by MIR will be disqualified. MIR and its affiliates assume no responsibility for late, lost, stolen, delayed, illegible, incomplete, or misdirected entry forms, or human error, or technical malfunctions, including but not limited to inability to access the website, lost, delayed or incorrect data transmission, interruption or failure, other electronic malfunctions, computer or telephone hardware or software failures, malfunctions or garbled transmissions. Weston and its affiliates are not responsible for any problems or technical malfunction of any telephone lines, computer online systems, servers, or providers, computer equipment, software, or injury or damage to entrant's or any other person's computer related to or resulting from participation in the contest or downloading any materials in relation to the contest. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the contest will result in disqualification. Any such action may be in violation of civil and criminal laws and Weston reserves the right to seek damages from any such person to the fullest extent permitted by law. None of Weston, nor its affiliates, or their respective independent distributors or advertising and promotional agencies or their respective agents, officers, directors, employees and representatives shall be responsible in any way for the use of or bear any liability whatsoever in any way attributable to a school's participation in this contest or the Grand Prize and/or Weekly Prizes awarded in this contest, including liability for any injury, loss or damages of any kind to persons, including death, and property.  Prior to delivery of the Grand Prize and Weekly Prizes, and in any event no later than 7 days after the winning school(s) have been notified of their selection, the potential winning school(s) Principal or vice principal will be required to sign and return a form satisfactory to Weston confirming compliance with the contest rules and acceptance of the Grand Prize and Weekly Prizes; permitting Weston and its affiliates and their respective independent distributors to use the winning schools' name, address, photograph and/or video image in any publicity and advertising without compensation, where legal; and releasing Weston, its affiliates and independent distributors and advertising and promotional agencies including MIR, and their respective agents, officers, directors, employees and representatives from any and all liability, damages, costs, expenses and claims arising out of or relating to the school's participation in this contest or the Grand Prize and Weekly Prizes.  In the event that the potential winning school(s) fails to sign such form, it will be deemed to have forfeited the prize, and an alternative potential winning school(s) will be selected. Except as permitted herein as it relates to the winning school(s), any personal information collected will be used only for the purposes of the contest.
  11. Employees, officers, directors, representatives and agents of Weston, MIR and any of their respective affiliated companies, and their respective promotional agents, and contest judges as well as those with whom such persons are domiciled, are NOT eligible. By entering, each entrant agrees to abide by the contest rules and to the decisions of Weston, which are final and binding in all respects. All entries become the property of Weston and none will be returned. Weston and its affiliates and independent distributors shall have the right at their option to publish the winning school(s)' name or to use the winning school(s)' name, address, photograph and/or video image for marketing and/or promotional purposes, without compensation, unless otherwise prohibited by law. No correspondence or communication will be entered into except with a selected entrant. Contest is subject to all applicable federal, provincial and municipal laws, and all applicable local, state, provincial, federal or international taxes, duties or fees are the sole responsibility of each winner and will be paid by the winner.
  12. Weston reserves the right in its absolute discretion to modify or withdraw this contest at any time, in whole or in part, without prior notification, for any reason.
